Terms of Service

By creating an account, accessing, or using Mast Creations ("the Service"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Mast Creations ("we," "us," or "our").

Mast Creations is a Software-as-a-Service (SaaS) platform that provides professional real estate photo editing services, including but not limited to:

• HDR image enhancement
• Day to dusk conversions
• Virtual staging
• Item removal and virtual cleaning
• Sky replacement and color correction
• 360° image enhancement

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with or without notice.

To use the Service, you must create an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

You may only use the features and access the data appropriate to your assigned role.

Your Content

You retain all ownership rights to the images and files you upload ("Your Content"). By uploading files to the Service, you grant us a limited, non-exclusive, royalty-free license to:

• Process, edit, and enhance your images as requested
• Store your files securely on our servers and third-party storage providers
• Deliver edited files to you via the platform
• Use anonymized, non-identifiable samples for quality assurance and training purposes

This license terminates when you delete your files or account, except where retention is required by law.

Representations and Warranties

By uploading content, you represent and warrant that:

• You own or have the necessary rights to the uploaded content
• Your content does not infringe on any third-party intellectual property rights
• Your content does not violate any applicable laws or regulations

If you are a paying customer:

• You agree to pay all fees associated with your use of the Service
• Prices are subject to change with 30 days' notice
• All payments are non-refundable unless otherwise stated
• Failure to pay may result in service suspension or termination
• You are responsible for all applicable taxes

Invoices are generated based on your billing type (weekly automatic or manual). Payment is due within the timeframe specified on your invoice.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not responsible for loss of data, profits, or business interruption

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, our liability will be limited to the maximum extent permitted by law.

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Any reason at our sole discretion

You may terminate your account at any time through the account settings. Upon termination, your right to use the Service will immediately cease, and we may delete your data in accordance with our Privacy Policy.

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. The Information Technology Act, 2000, and other applicable Indian laws shall apply.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in India.

For international users, we also comply with applicable international regulations including GDPR and CCPA.
